Un Mayor's decree establishes the precautionary and temporary suspension of the business license of the establishment located in the district of The flat during level 3 pre-emergency episodes that involve the closure of Natural Park Montgó and, at the same time, prohibit access via tracks, trails, and forest roads within the Montgó Natural Park. The resolution, signed on July 30th, was announced by the mayor, Rosa Cardona, during the ordinary plenary session held this Thursday.

A measure linked to the risk of fires

The decree is based on a report from the Local Police HeadquartersThe report analyzes the environmental conditions surrounding the Hacienda nightclub and the associated risks during periods of extreme fire danger. Among other aspects, the report notes that the establishment is located in a wooded area with only one access point, that the parking lot lacks a buffer zone around the trees, and that, after the night ends, numerous customers walk along forest paths throughout the evening.

The document also states that when the Generalitat decrees access restrictions to the natural park due to extreme fire risk, a situation arises that the Local Police describe as a "grave legal paradox", as recreational transit through the mountain is prohibited while a high number of people and vehicles continue to congregate in the vicinity of the establishment.

The suspension will be automatic during the park closure

The decree establishes that, once the Generalitat declares pre-emergency level 3 and the corresponding closure of the Montgó Natural Park, The effects of the opening and operating license will be temporarily suspended of the nightclub, ordering the cessation of activity for the entire period of validity of the regional resolution. The measure also extends to the use of the parking lot associated with the establishment.

The resolution also warns that, in the event of non-compliance with the cease and desist order, the Town Hall may proceed to closure and sealing of the establishment during the affected period, passing on to the owner the costs derived from the forced execution.

The measure was announced during the plenary session.

The existence of the decree was revealed by the mayor during the plenary session held this Thursday, in response to a question posed by the socialist group regarding the situation generated in several episodes this summer, when the Montgó Natural Park remained closed due to extreme risk of fires while the nightclub continued to operate.

According to the municipal file, the measure includes favorable reports from the Local Police and the municipal legal serviceswho believe that the City Council has the authority to adopt precautionary security measures in situations of serious risk to people, property and the natural environment.
